BLR/23/2 REVIEW OF SCRAP METAL DEALERS LICENSING POLICY 2023 PDF 87 KB Report from the Licensing Team Additional documents:
Minutes: 5.1 Tracy Howard, Corporate Manager - Public Protection presented Paper BLR/23/2 to the Committee. The report provided the Committee with information and guidance on a new draft Scrap Metal Dealers Licensing Policy, attached as Appendix A, and requested Members approval of the draft Policy for public consultation.
5.2 The Corporate Manager - Public Protection advised Members that Recommendation 3.2 had been amended to agree a consultation period of 7 weeks.
5.3 In accordance with the Scrap Metal Dealers Act 2013 (SMDA), Babergh District Council, in its role as Licensing Authority, is responsible for licensing scrap metal dealers as defined within the Act.
5.4 It was considered appropriate to produce a single policy for both Babergh and Mid Suffolk District Councils which sets out a clear and consistent framework for the Council’s approach to scrap metal licensing.
5.5 The Corporate Manager - Public Protection responded to Members questions, including: dealing with scrap metal theft, although a joint policy with Mid Suffolk – licenses are Council specific, the number of current collectors and the consultation process.
5.6 Councillor McCraw proposed the Recommendations as detailed in the Report. Councillor Jamieson seconded the proposal.
By a unanimous vote,
It was RESOLVED:
1.1 That the Licensing and Regulatory Committee agree the draft policy for the purposes of consultation. 1.2 That the Licensing and Regulatory Committee agree a consultation period of 7 weeks with licence holders and key stakeholders. 1.3 That the Licensing and Regulatory Committee deem the policy approved to proceed to Cabinet if there are no representations, or objections made against the draft policy.

BLR/23/3 REVISION OF LICENSING OF SEX ESTABLISHMENTS POLICY 2024-2029 PDF 90 KB Report from the Licensing Team Additional documents:
Minutes: 6.1 Tracy Howard, Corporate Manager - Public Protection presented Paper BLR/23/3 to the Committee. The report provided the Committee with information and guidance on a revised version of a single Policy for the Licensing of Sex Establishments, attached as Appendix A, and requested Members approval of the draft Policy for public consultation.
6.2 The Corporate Manager - Public Protection advised Members that Recommendation 3.2 had been amended to agree a consultation period of 7 weeks.
6.3 The Policing and Crime Act 2009 amended the Local Government (Miscellaneous Provisions) Act 1982 Schedule 3 to introduce a new classification of sex establishments, namely sexual entertainment venues.
6.4 Babergh District Council adopted the existing Policy on 14th June 2012, attached as Appendix B, and it had not been reviewed since.
6.5 It was considered appropriate to produce a single policy for both Babergh and Mid Suffolk District Councils. Minor amendments were also made to ensure the Policy reflected legislative changes.
6.6 The Corporate Manager - Public Protection responded to Members questions, including: which establishments were covered by the Policy.
6.7 Councillor Smith proposed the Recommendations as detailed in the Report. Councillor Owen seconded the proposal.
