Apologies of absence were received from Councillors Sue Ayres, John Hinton, Adrian Osborne and Lee Parker.

 

Councillor Margaret Maybury substituted for Councillor Sue Ayres.

 

Councillor Derek Davis substituted for Councillor John Hinton.

 

Councillor Jan Osborne substituted for Councillor Adrian Osborne.

 

Councillor Alastair McCraw substituted for Councillor Lee Parker.

DECLARATION OF INTERESTS

Members to declare any interests as appropriate in respect of items to be considered at this meeting.

 

Minutes:

Councillor Peter Beer declared a local non-pecuniary interest in application DC/19/01463 as he was the County Councillor for the area.

 

Councillor Derek Davis declared a local non-pecuniary interest in applications DC/19/01708 & DC/19/01634 as he was the representative on the AONB that affected both sites. Councillor Davis declared a further local non-pecuniary interest in DC/19/01634 as he knew one of the family members that owned the land.

 

Councillor Alastair McCraw declared a local non-pecuniary interest in application DC/19/01708 as he had previously been the Ward Member when an application had previously been submitted on the site. However, Councillor McCraw declared that he would be approaching the application with an open mind.

SITE INSPECTIONS

In addition to any site inspections which the Committee may consider to be necessary, the Acting Chief Planning Officer will report on any other applications which require site inspections.

 

The provisional date for any site inspections is Wednesday 24 July 2019.

23.1 The Case Officer presented Members with the request for site visit from Councillor Jan Osborne and gave a short presentation regarding DC/19/02315.

That Members undertake a site visit on the 31st July 2019 for Application:

Site Location       STUTTON – Land East of Church Road, Church Road, Stutton, Ipswich, IP9 2SG

25.2 The Case Officer presented the application to the Committee outlining the proposal before Members, the layout of the site, the contents of the tabled papers, and the officer recommendation of approval with conditions.

 

25.3 Members considered the representation from Chris Smith who spoke as the Applicant.

 

25.4 The Applicant responded to Members’ questions on issues including: the sustainability statement linked to the proposal, the ecology statement linked to the proposal and the engagement with the local community.

 

25.5 Members considered the representation from Councillor Mary McLaren who spoke as the Ward Member.

 

25.6 Members debated the application on the issues including: the environmental statement provided and, the ratio regarding Affordable Homes and bedrooms.

 

25.7 The Acting Area Planning Manager advised Members that a request could be made to the Local Highway Authority for public transport improvements to be secured through Community Infrastructure Levy (CIL) and that if a commuted sum was required this would have been contained in the response from the Local Highway Authority.

 

25.8 Members continued to debate the application on the issues including: the response from the Suffolk Wildlife Trust, the response from the Heritage Team, and whether Permitted Development Rights should be removed.

 

25.9 Councillor Melanie Barrett proposed that the application be approved as detailed in the officer recommendation. Councillor Jan Osborne seconded the motion.

 

25.10 Members continued to debate whether Permitted Development Rights should be removed from any approval. Councillor Melanie Barrett chose not to amend her recommendation and as such the seconder withdrew their support. The motion fell.

 

25.11 Councillor Jan Osborne proposed that the application be approved as detailed in the officer recommendation with the additional condition that permitted development rights regarding extensions and conversions of bungalow rooves be removed. Councillor Margaret Maybury seconded the motion.

 

25.12 When put to the vote, the motion was lost.

 

25.13 Members debated the application on the issues including: the change in the mix and type of the housing compared to the previous application on the site, the design of the site, the heritage harm identified, and the possible impact on Babergh’s Housing land supply.

 

25.14 A short adjournment was taken between 10:55-11:02 for Officers to confer.

 

25.15 Following the adjournment the Acting Area Planning Manager advised Members that in light of Members discussions and the failed motions the officer recommendation had been revised as follows:

 

To defer the application to look at the following areas with the applicant:

 

·       Needs for size of dwellings proposed

·       Size, scale layout and character of development in relation to setting of village.

·       Impact of additional bedrooms from previously approved outline from highways perspective.

26.2 The Case Officer presented the application to the Committee outlining the proposal before Members, the layout of the site, and the officer recommendation of approval with conditions.      

 

26.3 Members considered the representation from Tristan Lee who spoke as the Applicant.

 

26.4 The Applicant responded to Members’ questions on issues including: the proposed surfacing on the site, the footpath in the area, the low carbon design and construction process, and the possibility of PV panels.

 

26.5 Members debated the application on the issues including: the gradient of the site and the design of the proposal.

 

26.6 Councillor Dave Busby proposed that the application be approved as detailed in the officer recommendation. Councillor Derek Davis seconded the motion.

 

26.7 RESOLVED

 

(1)    That the Acting Chief Planning Officer be authorised to approve reserved matters of appearance, layout, scale and landscaping subject to conditions.
