1. DC/19/04923 – 111 Valid Signatures supporting the following statement:
- We, the undersigned residents of Monks Eleigh and surrounding villages, are strongly opposed to the establishment of a gypsy and traveller site on land north of second pits, Highlands Road, Monks Eleigh. We call on Babergh and Mid Suffolk District Councils to refuse planning permission. This land is situated in a peaceful rural area, not near amenities, and close to a listed building. It should be maintained for agricultural/ equine use and is completely unsuited to use as a gypsy and traveller site.
2. DC/19/00291 – 215 Valid Signatures supporting the following statement:
- I object to the planning application (DC/19/00291) of housing development as brought by Code Development Planners, at the land West of Church Road Bentley, Suffolk. The following reasons are of concern to me: infrastructure, village character, wildlife and safety. |

110.2 The Case Officer presented the application to the Committee outlining the proposal before Members, the layout of the site, and the officer recommendation of refusal.
110.3 Members considered the representation from Angela Forrest of Monks Eleigh Parish Council.
110.4 Members considered the representation from Robert Butler of Kettlebaston Parish Council.
110.5 Members considered the representation from John Dagg who spoke as an Objector.
110.6 Members considered the representation from Brian Riley who spoke as an Objector.
110.7 Members considered the representation from Councillor Bryn Hurren who spoke as the Ward Member.
110.8 Members debated the application on the issues including: the comments that had been made by members of the public regarding the proposal, the sustainability of the proposal, and the district need for Gypsy and Traveller pitches.
110.9 Councillor Lee Parker proposed that the application be refused as detailed in the officer recommendation with the additional reason as follows:

110.11 RESOLVED
That the application is REFUSED planning permission for the following reasons: 1. The proposed development for the creation of one new gypsy and traveller pitch comprised of one mobile home and two touring caravans fails to accord with the requirements expected for developments within the countryside, contrary to Policy CS2 of the Babergh Core Strategy (2014). Furthermore, the development fails to comply with the requirements of paragraph 8 of the NPPF, with the proposed development not considered to form sustainable development, with particular with regards to the poor access to services and sustainable transport links. The proposed development is situated on land outside of any settlement boundary remote from services and would lead to reliance on private car use which would not promote healthy living or sustainable transport, contrary to policy CS15 of the Babergh Core Strategy (2014) and paragraphs 8, 91, 103, 117 and 122 of the NPPF. As such the proposal is not acceptable in principle, being contrary to paragraphs 8, 91, 103, 117 and 122 of the NPPF (2019) and Policies CS2 and CS15 of the Core Strategy (2014).
2. Further, the application would result in a less than substantial level of harm to the setting of Wagger Farm, a Grade II listed farmhouse through the introduction of both alien materials and roof forms belonging to the proposed mobile homes and touring caravans. No positive public benefits associated with proposed development are identified as required by paragraph 196 of the NPPF. 111.2 The Case Officer presented the application to the Committee outlining the proposal before Members, the layout of the site, the contents of the tabled papers, and the officer recommendation of refusal.
111.3 Members considered the representation from Michael Bamford of Bentley Parish Council who spoke against the application.
111.4 Members considered the representation from Marianne Munday who spoke as an Objector.
111.5 The Objector responded to Members’ questions on issues including: The Neighbourhood development plan having specialist consultations for landscape, and the flooding that had been recorded in the area.
111.6 Members considered the representation from Helen Adcock who spoke as the Agent.
111.7 The Agent responded to Members’ questions on issues including: the affordable housing provision on the site, the deliverability of the site, and that a housing needs survey had been undertaken.
111.8 Members debated the application on the issues including: the Affordable Housing provision both on and off site, the deliverability of the site, and the sustainability of the proposal.
111.9 Councillor Derek Davis proposed that the application be refused as detailed in the officer recommendation. Councillor Stephen Plumb seconded the motion.
111.10 RESOLVED
Members resolved to:
(1) Refuse planning permission, for reasons including:
i. Policy CS2 of the Core Strategy seeks to direct new development sequentially to the towns / urban areas, and to the Core Villages and Hinterland Villages. Policy CS11 of the Core Strategy requires development to consider the landscape characteristics of the village, and also requires the identification of local housing need. Policy CS15 of the Core Strategy seeks to ensure that development respects landscape features. Furthermore, the LPA is able to demonstrate a 5 Year Housing Land Supply, thus the “tilted balance” of Paragraph 11(d) of the NPPF is not engaged.
ii. The circumstances of the application and the proposed development are not exceptional and are without a proven justifiable need, contrary to policy CS2. The application fails to adequately demonstrate how the proposal responds to a locally identified housing need, contrary to policy CS11 and paragraph 77 of the NPPF, which requires development in rural areas to be responsive to local circumstances and reflect local needs.
ii. The proposed development, by virtue of its scale, siting and location, would cause significant harm to the open countryside and the way that it is experienced and would fail to respect the local context and character, and the rural setting, of Bentley and its settlement, contrary to policies CR04, CS11, CS14 and CS15 of the development plan and paragraphs 98, 127, and 170 of the NPPF.

112.4 Members considered the representation from Chris Matthews of Capel St Mary Parish Council who spoke against the application.
112.5 The Parish Council representative responded to Members’ questions on issues including: the housing needs of the village.
112.6 Members considered the representation from Stuart McAdam who spoke as the Agent.
112.7 The Agent responded to Members’ questions on issues including: the number of bungalows proposed on the site, that the proposal did meet the parking standards, the mix of the housing on site, the density of the development, the affordable housing provision, and possible further ecological mitigation.
112.8 Members debated the application on the issues including: the number of houses permitted in the outline permission, the 35% Affordable Housing, the proposed street lighting and adoption of Highways, the density of the site, the proposed 3 storey development, and the impact on residential amenity.
112.9 At this point in the debate Councillor Busby declared that he had a Local Non-Pecuniary interest in the application as he lived within 100 metres of the site. Councillor Busby responded to questions from the Governance Officer that he did not think that this was a pecuniary interest and that that he was approaching the application with an open mind.
112.10 Members continued to debate the application on issues including: the proposed housing mix on the site.
112.11 Councillor Peter Beer proposed that the application be deferred for the reason as listed below:
- To seek improvement of design to flats; alter mix towards lower number of bedrooms, and increase number of bungalows.

The proposed development, by virtue of its scale, density and location, would adversely impact the character and appearance of the area, including the landscape qualities of the Special Landscape Area, contrary to Saved Policy CR04 of the Babergh Local Plan 2006, Policies CS11 and CS15 of the Babergh Core Strategy (2019) and the National Planning Policy Framework.
