Councillor Lee Parker declared a local non-pecuniary interest in applications DC/19/01422, DC/19/01427 & DC/19/01428 as he had Ward Member for the area before the May 2019 District Council Elections.

It was resolved that the Minutes of the meeting held on the 17 July 2019 were confirmed and signed as a true record.

31.

TO RECEIVE NOTIFICATION OF PETITIONS IN ACCORDANCE WITH THE COUNCIL'S PETITION SCHEME

Minutes:

31.1 The Governance Officer reported that a valid petition had been received with 20 valid signatories supporting the following statement:

 

“We the undersigned ask that Babergh District Council Planning Committee does not grant Retrospective Planning Permission for S73 Applications DC/19/01422, DC/19/01427 & DC/19/01428.”

 

It was noted that a large number of electronic signatures had been provided with the petition but could not be considered as they lacked the required information as detailed in the Babergh Petitions Scheme.

 

31.2 The Governance Officer reported that a further petition had been received that was linked to the Bures Applications but that it was not a consultation petition regarding any of the specific applications but with Babergh District Councils involvement with the site. As such the Petition would be reported to the next Full Council meeting.

 

 

 

 

 

 

 

32.

SITE INSPECTIONS

In addition to any site inspections which the Committee may consider to be necessary, the Acting Chief Planning Officer will report on any other applications which require site inspections.

32.1 The Case Officer presented Members with a request for a site visit from Councillor Leigh Jamieson and gave a short presentation regarding applications DC/19/02489 & DC/19/0288.

 

32.2 RESOLVED

 

That Members undertake a site visit on the 4th September 2019 for Applications:

Proposal             Application under Section 73A of the Town and Country Planning Act – Retention as built and completion of 2 no. two storey dwellings (plots 1 and 2 previously permitted by permission ref B/14/01103) with amendments to plots 1 and 2 comprising change in siting, site levels, ridge and eaves height and fenestration.

34.2 The Area Planning Manager addressed the Committee providing Members with a short preamble regarding the history of the site and the current status of Appeals that had been lodged to the Planning Inspectorate.

 

34.3 The Case Officer presented an overview of the three applications (DC/19/01422, DC19/01427 & DC/19/01428) in Bures St Mary outlining the proposal before Members. The Case Officer continued by presenting application DC/19/01422 to the committee outlining the proposal before Members, the layout of the site, and the officer recommendation of approval with conditions.

 

34.4 Members considered the representation from Gill Jackson of Bures St Mary Parish Council who spoke against the application.

 

34.5 Members considered the representation from Michael Harman who spoke as an Objector.

 

34.6 The Objector responded to Members’ questions on issues including: the changes that had happened on the site and that members were looking at a separate application. 

 

34.7 The Area Planning Manager advised Members that the previous decision on the site of unacceptable harm for plots 5 & 6 meant that the entirety of the application was Refused and that based upon the decision the Applicant had submitted plans regarding the remaining plots that weren’t identified as having unacceptable harm. Upon receipt of the applications, Officers had undertaken due process examining the applications and concluded with the recommendation of approval.

 

34.8 Members considered the representation from Kevin Leigh who spoke on behalf of the Applicant.

 

34.9 The Applicant’s Representative responded to Members’ questions on issues including: the previous decisions that had been made by Babergh Planning Committee, the driveways on the site, and the highways access to the site.

 

34.10 The Chair outlined to the committee that a video speech had been received by County Councillor James Finch regarding the application, however upon advice from Officers that this did not conform to the Public Speaking Charter Rules it was ruled out as inadmissible by the Chair. A written copy of the speech was provided to all Members within the tabled papers.

 

34.11 The Team Leader for Heritage and Planning Compliance advised Members that plots 1 & 2 were 3.5 metres forward of the approved plans but that the building was in accordance with the site boundaries.

 

34.12 Members debated the application on the issues including: the relationship of the application before Members compared to the original 2014 permission, that the applicant had applied for certificates of lawful development, the consultation process regarding the application, and the difference between the actual height of the property compared to the one that was proposed.

35.2 The Case Officer presented the application to the Committee outlining the proposal before Members, the layout of the site, and the officer recommendation of approval with conditions.

 

35.3 Members considered the representation from Gill Jackson of Bures St Mary Parish Council, who spoke against the application.

 

35.4 The Team Leader for Heritage and Planning Compliance advised Members that it was the Enforcement teams’ standard policy to invite the developer to make a retrospective planning application and that if this was to no avail then enforcement action would be taken.

 

35.5 Members considered the representation from Claire Frewin who spoke as an Objector.

 

35.6 Members considered the representation from Kevin Leigh who spoke as the Applicant’s representative.

 

35.7 The Applicant’s representative responded to Members’ questions on issues including: why the applications had been submitted and that the Council had deemed that these were materiel amendments to the planning permission.

 

35.8 Members debated the application on the issues including: the difference in actual height to that which was originally proposed and what was actually built, and that the Council had determined that the differences were of a material nature.

 

35.9 Councillor Stephen Plumb proposed that the application be approved as detailed in the officer recommendation. Councillor Adrian Osborne seconded the motion.

 

35.10 RESOLVED

 

That authority be delegated to the Chief Planning Officer to grant the application pursuant to the provisions of s.73A subject to the following conditions:-

 

• Approved plans (including relevant plans from permission B/14/01103)

• Layout of access, roadway, parking and turning area

• Retain SWD details as agreed for B/14/01103

Proposal             Hybrid Planning Application comprising: Full Planning Application – Proposed residential development comprising of 170 dwellings, associated infrastructure, the provision of Public Open Space and Structural Landscaping; and, Outline Planning Application – Outline: 0.65 hectares (10,000 sq ft.) (929sq. m.) of Class A, A3 and B1 employment uses and associated infrastructure and landscaping.

37.3 The Case Officer presented the application to the Committee outlining the proposal before Members, the layout of the site and the officer recommendation of approval with conditions.

 

37.4 Members considered the representation from the Applicant, Stuart McAdam.

 

37.5 The Applicant responded to Members’ questions on issues including: the possibility of tarmacking of verges, whether any of the proposed dwellings would be up to “Lifetime Homes Standards”, that the roads would be adopted by Suffolk County Council, the purpose of the employment land, the maintenance of the outdoor Gym equipment, and that a management company would maintain the open spaces.

 

37.6 Members debated the application on the issues including: the drainage on the site, the public transport in the area, the contributions that had been secured through the Section 106 Agreement and through Community Infrastructure Levy (CIL) payments.

 

37.7 From the Chair, Councillor Peter Beer proposed that the application be approved as detailed in the officer recommendation. Councillor Lee Parker seconded the motion.

 

37.8 RESOLVED

 

(1)  subject to the satisfactory completion of a S106 Agreement to secure the benefits identified in the report + any additional requirements identified by SCC and securing the appropriate linking of the employment and residential components of this site
