    It was RESOLVED: -

     

    1.1          That the contents of the report be noted.

    1.2          That a Civil Parking Enforcement (off street) report be produced annually each year going forward.

    1.3          That the Assistant Director for Environment and Commercial Partnerships requests an on-street parking report from Suffolk County Council and produces a report to be presented to Cabinet.

    REASON FOR DECISION

    To ensure that Members and the public are kept informed of the performance of the Civil Parking Enforcement function.

    Alternative Options Considered and Rejected:

    To not provide an update on performance for the first year of Civil Parking Enforcement (off street) – this option was not taken up, due to the clear need for keeping Members informed.

    Minutes:

    54.1       The Cabinet Member for Environment, Councillor Malvisi, introduced the report.

     

    54.2        Councillor Malvisi proposed recommendations 3.1 and 3.2 in the report, which was seconded by Councillor Osborne.

     

    54.3          In response to Councillor Holt’s questions regarding management of car parks in Babergh District, running cost of carparks, fixed penalties during the last financial year and the use of the data collected during that period, the Assistant Director for Environment and Commercial Partnerships responded that work was being undertaken in relation to Mill Lane to change the traffic regulations order, which included a statutory consultation with residents for the area.  There was a service level agreement in place with Ipswich Borough Council which included the Market Hill car park. The Councils paid a percentage of the cost towards a shared enforcement team, which looked after both the on-street and off-street parking across the District.

     

    54.4          In response to Councillor Holt’s further question the Assistant Director for Environment and Commercial Partnerships outlined the parking charges for the first quarter of the financial year in regard to fixed penalties and how the collected data could be use to determine the parking behaviour and parking usage in relation to parking penalties.

     

    54.5          The Assistant Director for Environment and Commercial Partnerships responded to Councillor Busby’s questions and clarified that it was Suffolk County Council which regulated on-street parking. She had requested an annual report for the District, which would be shared with the Cabinet in due course.

     

    54.6          Councillor Ward directed a question to the Assistant Director for Environment and Commercial Partnerships regarding arrangements for the carpark at the Railway Walk and she informed Cabinet that there were no traffic regulation orders in place for this Hadleigh car park, which an enforcement officer could enforce. However Public Realm did check it regularly.

     

    54.7          The Assistant Director responded to questions from other Members attending the meeting including the Council’s intentions and reasons behind parking enforcement.

     

    54.8          Councillor Osborne proposed that information regarding on-street parking was requested from Suffolk County Council and that a report was produced and presented to Cabinet.

     

    54.9          Councillor Busby stated there were many areas around the District where members of the public parked in inconsiderate places. He stressed that he thought it was important to receive information about the on-street parking to manage the problems. 

     

    54.10       Members debated the issues including  how to change peoples behaviour , the importance of encouraging the turnover of the number of people parking, on-street parking, the number of carparking ticket machines not fully functional, the distinction between on and off-street parking and the implication of  parking on verges.

     

    54.11       The Assistant Director for Environment and Commercial Partnerships detailed the powers available to enforcement officers when members of the public parked on verges and the regulation related to these issues.

     

    54.12       The Cabinet Member for Environment  responded to some of the comments made by Members including that blue badge holders were allowed to park on double yellow lines.

    REASON FOR DECISION

    Community Infrastructure Levy (CIL) monies have been collected since the implementation of CIL on the 11th April 2016. The CIL Expenditure Framework (originally adopted in April 2018 and reviewed with amendments adopted on the 18th March 2019 and with further amendments on the 20th April 2020 and March 2021) requires the production of a CIL Expenditure Programme for each District which contains decisions for Cabinet to make or note on CIL Bids for CIL expenditure. These decisions relating to the expenditure of CIL monies form one of the ways in which necessary infrastructure supporting growth is delivered.

     

     

    Alternative Options Considered and Rejected:

    There is a diverse spectrum of approaches to CIL expenditure across the country from Unitary Authorities who have absorbed CIL into their individual Capital Programmes to others who ringfence all funds to be spent locally. A range of different approaches was identified in Appendix A of the Framework for CIL Expenditure report provided to Cabinet’s on the 5th and 8th of February 2018 and discussed in full during the workshops with the Joint Member advisory panel. Members adopted the documents set out in paragraph 1.1 above by Council decision in April 2018 which were subsequently reviewed and adopted on the 19th March 2019 (Babergh) and 18th March 2019 (Mid Suffolk) and then reviewed for the second and third time and adopted by both Councils on the 20th April 2020 and 23rd March 2021(Babergh) and 25th March 2021(Mid Suffolk) respectively.

    Minutes:

    55.1      The Cabinet Member for Planning, Councillor Arthey, introduced the report, outlining the proposed CIL Bids.

    55.2      Councillor Arthey proposed recommendations 3.1 and 3.2 in the report.

    55.3      This was seconded by Councillor Busby.

    55.4      The Assistant Director for Planning and Building Control responded to Members questions. Some ward members and parish councils were proactive in submitting bids for CIL funding and the Council worked closely with those involved in the CIL funding process.

    55.5      The Cabinet Member for Planning advised that the Council offered a CIL enquiry service to prevent incorrect bid applications. The Council also assisted in other funding bids for community projects, including the Councils own community programme. Unfortunately, some Councillors did not understand the process and he provided some details of the funding process and the expectations of the applications for community project fundings. He agreed that further training and engagement was necessary.

    55.6      The Assistant Director for Planning and Building Control provided further details of how to apply for funding for community projects. He emphasised that the key question for communities intending to apply for funding should be how to improve the community.  The next step should be to contact either ward members or the Council to explore the range of funding opportunities available to them.

    55.7      Members debated the issues including that further training and engagement with communities should be provided by the Council and that CIL funding should be promoted to members and parish clerks.
