Proposal Outline Planning Application (all matters reserved) – erection of up to 65 dwellings with attenuation basin.
Site Location BACTON – Land on the west side of Broad Road, Bacton, Suffolk
Applicant Mr and Mrs G.J and C.A Abbott
44.3 The Case Officer presented the application to the Committee outlining the proposal before Members, the layout of the site, the proposed road improvements under the railway bridge, and a correction of the officer recommendation to delete the condition of “standard time limit” as the recommendation reduced the time frame to 18 months.
44.4 The Case Officer responded to Members’ questions on issues including: the current width of the road under the bridge and the proposed width, the sustainability of the proposal, the proposed pavement, that the previous permission on the site had expired, that all matters were reserved on the site, the detail of the proposed Section 106 Agreement, and the current weight of the emerging Joint Local Plan.
44.5 Members considered the representation from Rod Caird of Cotton Parish Council who spoke against the application.
44.6 Members considered the representation from Richard Peaty of Bacton Parish Council, who spoke against the application.
44.7 The Parish Representative for Bacton responded to Members’ questions on issues including: the distance to the local amenities.
44.8 Members considered the representation from Edward Gittins who spoke as the Agent.
44.9 The Agent responded to Members’ questions on issues including the Affordable Housing provision and that this would be determined at this stage of the application.
44.10 Members considered the representation from Councillor Andrew Mellen, Ward Member, who spoke against the application.
44.11 The Ward Member responded to Members’ questions on issues including: the public transport links in the area.
44.12 Members debated the application on the issues including: the stopping distance when travelling at 30mph in a vehicle, the details of the bridge and the proposed works to the road under the bridge, the current status of the 5 Year Housing Land supply, cycling safety from the site, the sustainability of the site, and the possibility of a site visit.
44.13 Members continued to debate the application on the issues including: pedestrian safety and whether it would improve the current situation, the detail of the design and that Suffolk Highways had recommended approval.
44.14 Councillor John Field proposed that the application be approved as detailed in the officer recommendation with the additional conditions as follows:
- Condition for sustainability measures to be agreed
- Condition for full technical details of the proposed footway scheme to be submitted to concurrent with reserved matters for agreement and with agreement of SCC
- In Section 106 Agreement, footway to be completed prior to first occupation.
44.15 Councillor Dave Muller seconded the motion.
44.16 By 6 votes to 2.
44.17 RESOLVED
(1) Subject to the prior agreement of a Section 106 Planning Obligation on appropriate terms to the satisfaction of the Corporate Manager - Planning for Growth to secure:
a) Provision and maintenance of public open space with equipped play (attenuation pond);
b) On site delivery of 35% affordable housing (22 units);
c) Highways improvements including off-site footpath link and Pound Hill underpass modifications;
d) Primary school build contribution – £262,864;
e) Secondary school transport contribution – £57,600.
(2) That the Chief Planning Officer be authorised to grant Outline Planning Permission for the erection of up to 65 dwellings with attenuation basin subject to conditions including:
· Full Reserved Matters [access, landscaping, layout, appearance, scale] supported with cross sections, levels, attenuation report, boundary enclosure details, lighting details, parking details, sustainability measures to be incorporated into the development, safety measures for attenuation pond area
· Submission of all reserved matters within 18 months
· Commencement within 18 months of RM approval
· Highways – Provision of footpath link
· Highways – Details of estate roads to be agreed
· Highways – Provision of carriageways and footpath prior to occupation
· Highways – Delivery plan during construction to be agreed
· A scheme of surface water drainage to be agreed
· Ecological management plan to be agreed
· Programme of archaeological work
· No occupation until archaeological assessment complete
· Remove permitted development rights
· Submission of materials Notes Section 38 of the Highways Act 1980 Section 278 of the Highways Act 1980 Scheme of archaeological investigation
(3) That in the event of the Planning Obligations referred to in Resolution (1) above not being secured that the Corporate Manager- Planning for Growth be authorised to refuse outline planning permission on appropriate grounds.
